Case Studies

Recent and ongoing projects include:

  • Advice to developers prior to acquisition of sites. In several instances research has revealed the continuing availability of "old" planning permissions which made a material difference to the development which could be achieved on the site. In other cases, research of the history of uses has revealed the potential for a Certificate of Lawfulness , which again has improved development prospects

  • Settling legal agreements to secure planning permission for a variety of projects including, a casino in an historic entertainment venue in Central London, affordable housing in major apartment and mixed use schemes in Westminster, Camden, Kensington & Chelsea, Southwark and Wandsworth; acting for a FTSE 100 property company on the first affordable housing “credit” scheme in Westminster

  • Advice to a top 10 plc on whether a site they proposed to purchase for their HQ still enjoyed the balance of a partially implemented planning permission

  • The first successful appeal for a truly outstanding new Country House in open countryside pursuant to Planning Policy Guidance Note PPG7, para. 3.21 and more recently, advice on presentation of similar projects pursuant to PPS7

  • Obtaining Lawful Development Certificates to boost prospects for development.

  • In the High Court A successful reported case on the proper interpretation of permitted development rights- as a result of which the party who lost has now instructed us to act for them on other planning matters!

  • Working with other firms of solicitors who need the benefit of our assistance to help their clients without any risk of harming their relationship

  • Advising on complex Planning Enforcement matters including in one case securing a substantial costs award in respect of an enforcement notice which was held on appeal to be a nullity

  • Assisting third parties with making written objections to adverse development proposals
